From 1 January 2010, modern awards created by the Australian Industrial Relations Commission, now known as Fair Work Australia, have applied to all Federal employers (Corporations or PTY LTD’s).

There are 122 awards which are industry or occupation specific. Most employers will be covered by an industry award, whereas occupational awards generally apply to certain professions regardless of the employers industry. An example of an industry award is the General Retail Industry Award 2010 whilst nearly all nurses are covered by the occupational Nurses Award 2010.

From 1 July 2010, the first transitional phase commenced where employers transitioned certain employee conditions from the pre-modern award to the modern award entitlement. The transitional process will occur in 5 equal instalments on each 1 July with the Federal Minimum Wage Increase until 2014.

The entitlements that can generally transition are:

  • Minimum wages and piecework rates;
  • Casual or part-time loadings;
  • Saturday, Sunday, Public holiday, evening or other penalties; and
  • Shift allowances/penalties.

All other Australian employers are covered by modern awards from 1 January 2011. These other employers include Sole-traders, Partnerships and remaining Not-for-Profit organisations.
